Terms of Service
The agreement between you and DANILO ALVES RODRIGUES LTDA for the use of this website and the CastorStack products.
Who you are contracting with
This website and the CastorStack products are operated by DANILO ALVES RODRIGUES LTDA, a company registered in Brazil, referred to in these terms as "we" or "us". You can contact us at support@castorstack.com. By buying or using our products you enter into an agreement with DANILO ALVES RODRIGUES LTDA on the terms set out below.
Acceptance of these terms
By accessing this website, creating an account or purchasing a product you confirm that you have read and accept these terms, together with our privacy policy and refund policy. If you do not accept them, do not use the service. If you are accepting on behalf of a company, you confirm that you have authority to bind it.
Your account
You must give accurate registration details, keep your credentials confidential and are responsible for everything done under your account. Tell us at support@castorstack.com as soon as you suspect unauthorised use. Accounts are personal to you or your organisation and may not be shared or resold.
License to use the products
On payment of the applicable fee, DANILO ALVES RODRIGUES LTDA grants you a non-exclusive, non-transferable, worldwide license to use the product within the scope of the tier you bought, as summarised on the license page. Source code delivered to you may be modified and used to build and ship your own products. You may not resell, sublicense or redistribute the product itself, in whole or in substantial part, as a competing template, starter kit or boilerplate. We retain all intellectual property rights in the product; you retain all rights in what you build with it.
Orders, prices and payment
Orders are placed and processed by Paddle.com Market Ltd, acting as merchant of record and reseller for DANILO ALVES RODRIGUES LTDA. Paddle's own buyer terms apply to the payment transaction. Prices are shown before checkout and may include applicable taxes collected by Paddle. Prices may change at any time, but a change never affects an order already paid. Subscriptions renew automatically for successive periods until cancelled, and you may cancel at any time from your account or by writing to support@castorstack.com.
Refunds and cancellation
Refunds are governed by our refund policy, which forms part of these terms: a full refund within 14 days of purchase, for any reason, with the exceptions described there. Nothing in these terms limits the statutory consumer rights of the country you live in.
Acceptable use
You agree not to use the service to break the law, to infringe anyone's rights, to send spam or malware, to attempt to gain unauthorised access to our systems or those of other users, to interfere with the operation of the service, or to circumvent the license limits you bought. We may suspend access that puts the service or other customers at risk.
Availability and support
We aim to keep the service available continuously, but access may be interrupted for maintenance, updates or reasons beyond our control, and we do not promise uninterrupted or error-free operation. Support is provided by email at support@castorstack.com during business days, within the scope of the tier you bought.
Third-party services
The products integrate with third-party services such as payment providers, hosting platforms and email providers. Those services are governed by their own terms and we are not responsible for their availability, pricing or acts.
Warranty disclaimer
Except for the warranties that cannot be excluded under the law that applies to you, the products are provided "as is" and "as available", without warranty of any kind, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. You are responsible for evaluating whether the product suits your needs and for everything you build and operate with it.
Limitation of liability
To the maximum extent permitted by law, DANILO ALVES RODRIGUES LTDA is not liable for lost profits, lost revenue, lost data or any indirect, incidental or consequential damage arising from the use of the products. Our total aggregate liability under these terms is limited to the amount you paid us in the 12 months before the event that gave rise to the claim. Nothing here excludes liability for fraud, wilful misconduct or anything else that cannot be excluded by law.
Indemnity
You agree to hold DANILO ALVES RODRIGUES LTDA harmless from claims brought by third parties that arise out of the products you build and distribute using our software, out of your breach of these terms or out of your unlawful use of the service.
Suspension and termination
You may stop using the service and close your account at any time. We may suspend or terminate access if you materially breach these terms and do not fix the breach within 15 days of being notified, or immediately where the breach is unlawful or harmful. Perpetual licenses already paid for survive termination of your account, except where the termination is caused by a breach of the license itself.
Changes to these terms
We may update these terms as the service evolves. The current version is always the one published on this page, with the date shown at the bottom. Material changes are announced by email to account holders at least 30 days before they take effect, and continuing to use the service after that means you accept the new version.
Governing law and disputes
These terms are governed by the laws of Brazil, and the courts of the domicile of DANILO ALVES RODRIGUES LTDA have jurisdiction, without prejudice to the right of a consumer to bring proceedings in the courts of the country where they live. We will always try to resolve a dispute informally first: write to support@castorstack.com before starting any proceedings.
General
These terms, together with the privacy policy, the refund policy and the license page, are the entire agreement between you and us about the service. If a provision is found unenforceable, the rest remains in force. Our failure to enforce a right is not a waiver of it. You may not assign this agreement without our consent; we may assign it as part of a merger or sale of the business.
